A Lampasas High School student was arrested on campus April 4 on a warrant from the Lampasas Police Department for a charge of aggravated sexual assault of a child.
Adrian Andrew Bernal, 17, of Lampasas was arrested on the firstdegree felony charge by the LHS school resource officer during school hours.
Lampasas Police Department Sgt. Investigator Larry Wilson said the incident is still under investigation.
Under the Texas Penal Code, a charge of aggravated sexual assault of a child involves a person intentionally or knowingly committing a sexual act with a child under the age of 14 for aggravated status, and under 6 years old for super-aggravated status.
Aggravating factors that lead to a firstdegree offense include causing or the attempted causing of serious injury or death, acting with disregard to human life, use of drugs to render the child unable to resist or consent, and use of a deadly weapon.
Sentencing time for first-degree aggravated sexual assault of a child varies from five to 99 years or life in prison; fines can range up to $10,000.
If the victim is 6 years old, or under 14 with certain aggravating factors, the minimum sentence is 25 years without parole.
