DISTRICT COURT

Lampasas County 27th District Court convened last week with Judge John Gauntt presiding over the day’s hearings.

At her punishment hearing, 42-year-old Erin Noelle Lippe of Copperas Cove was found guilty of driving while intoxicated, third or more. She was given six years in the Texas Department of Criminal Justice, probated to four years’ probation, with a $750 fine. She also is to pay $384 in court costs plus attorney fees.

Vincent Alexander Clark, 21, of Killeen received three years’ deferred adjudication probation with a $1,000 fine for possession of a controlled substance less than 1 gram. In addition, he was ordered to pay court costs of $284 and attorney fees.

And Amber Nichole Johnson, 23, of Lampasas had her probation amended to include treatment at Central Texas Treatment Center as a sanction. She is charged with possession of a controlled substance less than 1 gram.

Terry Lee Roberts, 32, of Lampasas entered a plea on his charge of assault causes bodily injury to a family member, but the finding was withheld. Punishment hearing with a presentence investigation is set for Oct. 6.

Dusty Wayne Sutton, 32, of Lometa entered a plea on his charge of possession of a controlled substance less than 1 gram, and that finding was withheld. Punishment is slated for Oct. 6.

At pretrial hearings last week, bond was found insufficient for 43-year-old Kimberly Kay DelaCruz of Lampasas. Her drug test results were positive, and new bond was set at $30,000. Capias warrants are to be issued for the defendant, who faces two charges of possession of a controlled substance less than 1 gram. A jury trial is scheduled Nov. 27 on those charges.

A capias warrant also was to be issued for Jaime Renee Harris, 38, of Buda after the defendant failed to appear in court Aug. 4 for an adjudication announcement. She is charged with possession of a controlled substance less than 1 gram.

On the court docket for today are the following:

Arraignment of Derrick Bronshae McClintock, 31, of Harker Heights, charged with theft of service over $2,500 and less than $30,000.

Arraignment of Chase Brianne Klander, 20, of Leander, charged with possession of a controlled substance over 4 grams and less than 400 grams.

Pretrial hearing for Hunter McCann Thompson, 33, of Waco, charged with hindering apprehension or prosecution of a known felon.

Pretrial hearing for David Magdaleno Bailon, 28, of San Angelo, charged with manufacture/delivery of a controlled substance over 200 grams and less than 400 grams.

Scheduled for Aug. 18 are:

Arraignment of Austin Cody Kemp, 27, of Lampasas, charged with assault on a family/household member with a previous conviction.

Arraignment of Thomas Matthew Kephart, 42, of Copperas Cove, charged with evading arrest/detention with a vehicle.

Arraignment of Latisha Nicole Charity, 24, of Killeen, charged with possession of a controlled substance less than 1 gram.

Arraignment of Guy Hollis Smith, 20, of Lampasas, charged with indecency with a child-exposes.

Arraignment of Russell Jay Smithers, 53, of Seguin, charged with forgery of a government/national instrument/money/security.

Pretrial hearing for Brian Andrew McBrayer, 49, charged with theft of cattle/horse/ exotic livestock less than $150,000-enhanced. A waiver of arraignment was filed.

Pretrial hearing for Jordan Gregory Griffin, 30, of Austin, charged with driving while intoxicated-third or more.

Plea hearing for Donnely Frank Richey, 31, of Lampasas, charged with possession of a controlled substance over 4 grams and less than 200 grams.

Plea hearing for Kenneth Gene McKee, 33, of Kempner, charged with driving while intoxicated with a child under 15 years of age.

Plea hearing for Jose Oswaldo Carlos-Tellez, 25, of Lampasas, charged with possession of a controlled substance less than 1 gram.

Open plea for Clarence Michael Biddy, 36, of Lampasas, charged with possession of a controlled substance over 1 gram and less than 4 grams. Biddy also has punishment hearings Aug. 18 on one charge of forgery of a government instrument/money/ securities and one charge of evading arrest/detention with a vehicle.

Adjudication announcement for Edwin Herbert Phelps, 29, of Lometa, charged with evading arrest/detention with a vehicle.

Revocation announcements for David Kellough Payne, 32, of Copperas Cove. He has one charge of driving while intoxicated and felony repetition, and one charge of bail jumping and failure to appear-felony.

Records show the following are set for Sept. 15 court action:

Arraignment of Donald Wayne Smith, 22, of Lampasas, charged with assault on a family/household member with a previous conviction. The court also issued an order for competency.

Pretrial hearing for Anthony Dennis Crowley, 37, of Lampasas, charged with possession of a controlled substance less than 1 gram. A waiver of arraignment was filed.

Arraignment of Troy Walker Neville, 45, of Lampasas, charged with possession of a controlled substance less than 1 gram.

Pretrial hearing for Roy Steven Whisenhunt, 52, of Killeen, who faces two charges of prohibited sexual conduct with an ancestor/ descendant. A waiver of arraignment was filed.

Plea hearing with presentence investigation for David Lee Havins, 34, of Lampasas, charged with possession of a controlled substance less than 1 gram.

Plea hearing with presentence investigation for John Wayland McBeth, 40, of Kempner, charged with driving while intoxicated-third or more.

Plea hearing with presentence investigation for Adrian Louis Navarro, 30, of Lampasas, charged with indecency with a child-sexual contact.

Adjudication hearing for Michael Douglas Smith, 28, of Copperas Cove, charged with theft over $1,500 and less than $20,000.

A trial is scheduled Sept. 27 for 44-year-old Jerry Lee Pierce of San Saba. He faces a charge of manufacture/delivery of a controlled substance over 1 gram and less than 4 grams.

On Oct. 6, 25-year-old Meghan Elise Bray of Copperas Cove is set for an adjudication hearing on her charge of forgery of a financial instrument.

Michael Rodney Jones, 39, of Copperas Cove has an arraignment reset for Oct. 13. He is charged with theft of property over $2,500 and less than $30,000.

A jury trial is planned Oct. 23 for Alexis Paige West of Buchanan Dam. The 20-yearold woman is charged with possession of a controlled substance over 1 gram and less than 4 grams.

And a revocation announcement is on the Nov. 3 docket for Joseph Randall Jacobs, 35, of Lampasas. A $1,000 personal recognizance bond was approved for the defendant. Jacobs is charged with possession of a controlled substance less than 1 gram.
