Capital murder charge is filed

Lowell Preston Garza, 20, of Lampasas was indicted Wednesday by the Lampasas County grand jury for capital murder.

The charge stems from Garza’s arrest Aug. 17 in connection with the death of his two-month-old daughter, Isabela Preslei Garza.

A written autopsy report from the Dallas medical examiner received by Lampasas County Sheriff David Whitis ruled the death a homicide by blunt-force trauma.

Officials from the Sheriff’s De- partment responded to Metroplex Hospital in Killeen on Aug. 17 after being contacted by hospital personnel about a deceased infant, according to Whitis.

The infant was brought to the hospital by her parents for treatment.

As a result of the early investigation by Texas Rangers and the Sheriff’s Department, deputies arrested and charged Garza and his wife, Crystal Raquel Garza, 19, with injury to a child with the intent of serious bodily injury.

The couple were arraigned, and bond was set at $1 million for Garza and $750,000 for his wife.

Mrs. Garza was released from the Lampasas County Jail after posting a $3,500 bond on Aug. 21. Her bail was reduced from the original amount.

The case remains under investigation.

Garza is still in the county jail.

Lampasas County District Attorney Larry Allison, who will prosecute the case against Garza, said the punishment for capital murder is the death penalty or an automatic life sentence without the possibility of parole.

Allison said he is not seeking the death penalty in this case, and if convicted, Garza would receive a life sentence without parole.

The district attorney said he expects the capital murder charge trial to begin early next year.
