Matter against city is closed
This week marked the end to months of disagreement between the city of Lometa and local resident Rigo Reyes who had filed suit against the city for breach of contract. In the court of County Judge Wayne Boultinghouse, the matter was closed by a decision of instructed verdict.
According to court officials, the plaintiff, Reyes, did not present sufficient evidence to rule in his favor. The jury was directed by Boultinghouse to give an instructed verdict in favor of the defense, and the city of Lometa was held unaccountable in the matter.
The suit stemmed from a verbal agreement with Reyes, with no written contract, for the removal of used tires from Lometa Regional Park. With Reyes paid for services rendered, the city chose to seek another, less expensive, avenue of removal.
In response to the city of Lometa's decision to end the arrangement, Reyes filed against the municipality, citing breach of contract. The matter was initially dismissed by Pct. 2 Justice of the Peace Dick Lockett due to jurisdiction.
A settlement offer was made to Reyes and refused earlier this year, with Reyes choosing to pursue the matter in civil court.
